Agreement to Terms

By accessing and using EstateSail's mobile application and services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

Use License

EstateSail grants you a limited, non-exclusive, non-transferable, revocable license to use our mobile application for your personal, non-commercial purposes.

User Account

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access

Account Responsibilities

• You are responsible for all activities under your account
• You must not share your account credentials
• You must not use the service for any illegal purposes

Service Rules

Acceptable Use

You agree not to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Upload malicious code or content
• Attempt to gain unauthorized access
• Use the service for spam or harassment

Content Guidelines

• You retain ownership of your content
• You grant us license to use your content for service operation
• You must have rights to content you upload
• We may remove content that violates our policies

Payments and Fees

• All fees are in USD unless otherwise stated
• Fees may change with notice
• No refunds unless required by law
• You are responsible for all applicable taxes

Payment Processing Fees

EstateSail offers integrated payment processing through Stripe. By connecting your Stripe account to EstateSail, you agree to the following:

1. Stripe Processing Fees. All payments processed through Stripe are subject to Stripe's standard processing fees as outlined on Stripe's pricing page. These fees are charged by Stripe directly and are separate from any EstateSail fees.
2. EstateSail Platform Fee. In addition to Stripe's processing fees, EstateSail charges a platform convenience fee of 1% of each transaction total processed through the Stripe integration. This fee is automatically deducted from the transaction payout before funds are deposited to your connected Stripe account.
3. Fee Transparency. The 1% platform fee applies to all Stripe payment methods available in EstateSail, including Tap to Pay on iPhone, Bluetooth card readers, and any future Stripe-powered payment options. This fee does not apply to payments processed through other payment methods (e.g., Cash, Venmo, PayPal, Zelle, Square).
4. Fee Modifications. EstateSail reserves the right to modify the platform fee percentage with 30 days' prior written notice to users. Continued use of the Stripe integration after such notice constitutes acceptance of the updated fee.
5. No Hidden Fees. The 1% platform fee is the only fee charged by EstateSail on Stripe transactions. There are no setup fees, monthly fees, or cancellation fees associated with the Stripe integration.

• You may not use our IP without permission
• We respect others' intellectual property rights

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

Limitation of Liability

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes.

Termination

We may terminate or suspend your account for violations of these terms.

SMS/Text Messaging Terms

Program Name

EstateSail SMS Notifications

Program Description

EstateSail uses SMS text messaging to send customers transactional notifications related to estate sale check-in status, one-time purchase receipts, and (with explicit opt-in) promotional notifications about upcoming estate sales.

Message Types

• Check-in notifications: Sent when you check in to an estate sale, including your queue number and entry instructions.
• Purchase receipts: A one-time SMS receipt sent after you complete a purchase at an estate sale.
• Promotional messages: Notifications about upcoming estate sales, sent only if you explicitly opt in.

Message Frequency

Message frequency varies. Transactional messages (check-in and receipt) are sent only in direct response to your actions. Promotional messages, if opted in, are sent no more than a few times per month.

Msg & Data rates may apply. Please contact your wireless carrier for details about your messaging plan.

Opt-In

By providing your mobile phone number during estate sale check-in or at checkout, you consent to receive transactional SMS messages from EstateSail related to your check-in or purchase. Promotional messages are only sent if you explicitly opt in by selecting the promotional messaging checkbox. Consent is not a condition of purchase.

Opt-Out

You can opt out of SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and will no longer receive SMS messages from EstateSail. To re-subscribe, reply START.

Privacy

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States.
